IHH, on Feb 19, announced that its indirect wholly-owned subsidiary, Northern TK Venture (NTK), has filed a petition to the Tokyo District Court on Feb 12 to amend its claim against Daiichi Sankyo.
The amendment takes into the consideration the completion of IHH’s open offers for Fortis Healthcare and Fortis Malar Hospitals were completed on Nov 10, 2025.
NTK had originally sought INR109.3 billion (RM5.7 billion or $1.5 billion) for losses arising from NTK’s tortious claim against Daiichi Sankyo. NTK was also seeking 5 million yen (RM142,860 or $40,930) for losses arising from its defamation claim against the latter. The 5 million yen includes accrued interest on the damages claimed.
NTK had also sought an injunction to prevent Daiichi Sankyo from obstructuring the open offers by making “defamatory statements” to the Security and Exchanges Board of India (SEBI) and to any other third parties, including the public at large. NTK had further sought to have a statement published on Daiichi Sankyo’s website and for the latter to issue a statement to SEBI to vindicate NTK’s reputation.
With the open offers now completed, the injunctive claim has been updated to prevent Daiichi Sankyo from obstructing the acquisition of shares and any other investment and corporate exercises in respect of Fortis and Malar by NTK. There is no change to the other reliefs sought by NTK.
Shares in IHH closed 7 cents higher or 2.47% up at $2.90 on Feb 19.
